Terms of Service

Last updated October 19, 2026Previous versions →

These are the terms for using Wendy. They are written to be read. If anything here is unclear, write to us and a person answers.

1.Who we are, and who Wendy is for

Wendy is made by AskWendy LLC, a Virginia limited liability company, at 4726 16th Rd N, Arlington, VA 22207. These Terms are an agreement between you and us. In these Terms, “Wendy” is the service and “we” is the company.

Wendy is for adults. You must be 18 or older to use it, and you confirm that before you start.

You sign in with Google, with Microsoft, or with a six-digit code we email you. There is no password. You are responsible for the email address you use and for keeping access to it, because it is how you get back in and how we reach you.

By continuing past the sign-in gate, or by paying for a plan, you agree to these Terms and to our Privacy Policy. We record which version you agreed to and when.

2.What Wendy is and is not

Wendy is an AI coach, not a therapist, counselor or doctor, and not HR. Never used for hiring, reviews or pay. 18+. Companion AI may not be suitable for some minors.

Wendy is software, not a person. It says so before you start, at the start of every session, every three hours of continuous use, and whenever you ask. It has warmth, not feelings.

Wendy does not give medical, legal, financial or mental-health advice, and nothing it says is a substitute for any of them. There is no professional relationship between you and Wendy or between you and us. When a question is one a coach should not answer, Wendy says so in a sentence and names the kind of professional to ask.

Wendy can be wrong. Treat what it says as a suggestion to test against your own judgment.

If you may be in danger, contact 988 (in the United States, call or text), text HOME to 741741, or your local emergency number. Wendy shows you these whenever a conversation suggests you might need them, and our safety protocol says exactly what it does.

3.Modes, connectors and workspaces

Wendy has a work side and a home side. Each has its own notebook, and nothing crosses from one to the other unless you mark one thing to be remembered everywhere. The home side asks for your consent before it starts, because you may bring up health or family matters there.

You may connect only accounts that are yours or that you are permitted to connect. Wendy reads a connected account to write one-line notes for you. Learned from your communications, no messages are ever kept; the whole of what it keeps is at askwendy.ai/privacy/connectors. Nobody connects an account for you, and no company can connect one on your behalf. You can disconnect any account in one tap.

If you join a workspace your employer or another organization pays for, that organization controls only the roster (your name as entered, your work email, your seat) and your workspace profile: your card, your scores as bands, what you need from people, your pair and group pages, and the working habits Wendy derives from your own use, as our privacy policy lists them and as you see them when you join; you can take any one thing out of your workspace profile at any time. Everything else you make with Wendy is yours and stays under this agreement, governed by these Terms and our Privacy Policy, not by your employer. We will not give your Coaching Data to your employer, and our agreement with them forbids them from asking. When your seat ends, your account and its contents stay with you.

Write to support@askwendy.ai to leave a workspace; we remove your profile from every group and pair and confirm by email. Everything you made stays with you. Profile & settings lists the workspaces you are in; when it can also take you out of one, it will do the same thing.

4.Acceptable use, and never for employment decisions

You may not use Wendy, or any data from it, in hiring, performance review, promotion or compensation decisions.

Wendy is a self-development and communication coaching service. Your profile, scores, code, pattern, “how to work with me” page, notes, interview answers, memory, connector-derived notes, conversations and any other output (your “Coaching Data”) are provided to you for your own use. Neither you, nor any employer, manager, workspace administrator or other person may use, request, collect, infer or attempt to obtain Coaching Data (a) as a factor in any decision about who gets a job or a role, who moves up, what anyone is paid, discipline, reviews or ratings, who is chosen for training, who is let go, how work is handed out, or any other term or condition of employment; (b) to monitor or evaluate the performance or behavior of any worker; (c) to compare identified people with each other or put them in order; or (d) in any grievance, investigation or proceeding.

Wendy is not designed, tested or offered as a selection procedure, an employment test, or a clinical or medical instrument, and it has not been assessed under the Uniform Guidelines on Employee Selection Procedures (29 C.F.R. Part 1607) or any similar standard. Any use this section forbids is outside Wendy’s intended purpose, is a material breach of these Terms, and is at that person’s or organization’s own risk, including any duty such a use would create for them under Regulation (EU) 2024/1689 or any law on automated employment decision tools.

If you administer a workspace, you will, when we ask, show us that Wendy and its Coaching Data are not used as a factor in any employment decision: for example, by confirming it in writing, by showing us the notice you sent your people, or by describing how the decision in question was made. If we know, or have reason to believe, that a workspace or anything from it is being used for a purpose this section forbids, we may suspend or end that workspace without notice to the organization, and we will tell the workspace’s members that we did and why, in plain words. Ending a workspace does not touch any member’s own account or Coaching Data, which stay theirs.

  • Do not use Wendy, or let anyone use it, for or with anyone under 18.
  • Do not try to obtain another person’s data, another person’s account, or anything Wendy holds for someone else.
  • Do not abuse Wendy or the people who work on it. We may close an account that is used to abuse the service, as the section on ending the service says.
  • Do not scrape Wendy, resell it, or use its output to build a product or a data set at scale.
  • Do not try to get around a limit, the sign-in checks, or the safety response.

5.Your content and Wendy’s output

You own what you write to Wendy and what Wendy writes for you. You give us permission to store and process it only to run Wendy for you, to keep it safe, and to comply with law. We do not use your content to train AI models, and our AI provider is contractually forbidden from doing so.

Wendy’s output is generated by AI and may be wrong, incomplete or out of date; you are responsible for how you use it. Everything Wendy remembers about you is listed on the Memory page, where you can edit or delete any one thing.

Text that leaves Wendy, in a PDF, an email or a shared card, says that AI generated it.

6.Plans, invitations, cancellation and refunds

The report is free, complete, and needs no card.

Daily coaching is sold to teams, as a workspace. There are two plans, Team and Company; the pricing page says what each includes and costs, and the plan you pick, the number of seats and the exact date of the first charge are shown at checkout before you pay. Nobody can buy coaching for one person alone today; a seat in a workspace is the way in.

A workspace starts with 14 days free with a payment card on file. We email the owner the amount and the first-charge date the day the workspace is set up, and again before the first charge. Cancel from the workspace’s billing page before that date and nothing is charged; cancel after it and the workspace stays open until the end of the period you paid for. Stripe handles the payment, and the card number never reaches us. The owner buys the plan and accepts these Terms and our Data Processing Agreement at checkout.

Seats can be added or removed at any time; once the trial has ended, a change is prorated on the next invoice. Moving from Team to Company takes effect at once and is prorated the same way; moving from Company to Team takes effect at the next renewal. If a price changes after a workspace is on a plan, we will email its owner 30 days before it applies.

If you want a refund, write to support@askwendy.ai within 14 days of the first charge and we refund it in full, once per workspace. After that a person still reads every request and answers, and any right to a refund or to withdraw that the law gives you, including in the EU and the UK, stays yours.

Some people have coaching through an invitation from us or a complimentary plan, at no charge; nothing changes for them. Your report, your card and your free account are yours to keep either way.

7.Privacy

Our Privacy Policy is part of these Terms. In short: your data is yours. You can download everything under Profile & settings, delete anything Wendy remembers, a connected account, your report, a notebook or the whole account, and a deletion is carried out within 30 days. Learned from your communications, no messages are ever kept. Nobody trains AI models on your data.

When you leave a workspace, or your seat ends, your profile in that workspace is deleted. Your own account and everything in it stay with you.

8.AI disclosure, the safety protocol, and age

Our AI disclosure page, How Wendy works, and our safety protocol are part of these Terms. They say which models run Wendy, what it optimizes for, what it cannot do, and exactly what happens when a conversation suggests someone may be in danger.

If a conversation suggests you may be in danger, Wendy stops coaching, says in one short message that it is software and that this is bigger than a coach, shows you where to get help, and pauses check-ins for 24 hours. Nothing else happens in that turn.

If we learn that a user may be under 18, we end the session and pause the account, and we write to the account holder. A person at Wendy decides what happens next; software never does that on its own. If the person tells us they are under 18, or a person at Wendy confirms it, we close the account and delete its data. If we hear nothing, the account stays paused, not deleted. You can reply to our email or write to hello@askwendy.ai at any time to say you are 18 or older, to appeal, or to ask us to explain a decision.

9.Disclaimers and limits on our liability

Wendy is provided “as is”. We do not promise that it will be right for your situation, that it will always be available, or that what it says will be correct. To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability to you is limited to the amount you paid us in the twelve months before the claim.

Nothing in these Terms limits liability that the law does not allow us to limit, including for death or personal injury caused by our negligence, or for fraud. If you live in the EU or the UK, your statutory consumer rights are not affected by these Terms.

10.Ending the service, changes to these Terms, law and disputes

You can stop using Wendy and delete your account at any time under Profile & settings. We may suspend or end an account that breaks these Terms, and we will tell you why unless the law prevents us from doing so.

We may change these Terms. When a change reduces a right you have or adds a purpose for which we use your data, we email account holders 30 days before it takes effect; this is a service notice, so it is sent even if you have switched other email off. If you do not agree to a change, delete your account before it takes effect. Previous versions stay readable at the link under the title of this page.

These Terms are governed by the laws of the Commonwealth of Virginia and of the United States, without regard to conflict-of-law rules. Disputes go to the state or federal courts sitting in Virginia, and you and we each accept their jurisdiction. If you live in the EU or the UK, you keep the protection of the mandatory consumer law of the country you live in and may bring a claim in its courts, and nothing here takes away a right you have to bring a claim together with other people where the law gives you one.

California residents: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
